Know the Real Estate Laws in Thailand Affecting Foreigners

If you’re considering buying a new condo in Hua Hin, Thailand, as an investment property or a vacation home, there are some real estate laws you should be aware of before making your purchase.
Condo ownership by foreigners is perfectly legal in Thailand and encouraged as an investment in the country's economy. There is also no limit on the number of condos a foreigner can own. However, there can be limits on condos in specific developments that can legally be bought by foreigners, as we’ll explain.
51% of Condo Units Must Be Thai-Owned
Thailand's real estate laws specify that 51% of the condo units in any development must be sold and owned by Thai citizens. In practice, this means that foreigners can't own more than 49% of the total unit floor area in a single development.
You may find a beautiful, half-occupied development in the perfect location, only to be told that, as a foreigner, you’re not eligible to buy an unoccupied unit. The 51% law is generally the reason. Developers who have reached their quota of foreign-owned condos but still have units available can legally only lease or rent them to foreigners.
Foreign Currency Must Be Used to Purchase Condos
Number 5 under Section 19 of the Thailand Condominium Act states that foreigners can qualify for condo ownership by bringing in funds from overseas to pay for the condo. The funds must be deposited into a Thai-owned bank and transferred to the condo seller or developer. If your primary home is overseas, this is the easiest way to qualify for condo ownership in Thailand.
The Condo Must Be Registered Under the Condominium Act
Foreigners can only legally own condos that have been registered and licensed with the Land Department. Condos not registered and licensed can only be offered to foreigners on a leasehold arrangement or rental basis.
Leasing and Tenancy Rights of Foreigners
A property lease in Thailand is governed by the “Hire of Property” sections 537 to 571 of the Civil and Commercial Code. Thailand does not have separate leasehold laws governing foreigners. A leasehold arrangement can be negotiated between a condo owner and a foreigner for a period not exceeding 30 years. Any additional tenancy is not protected by Thai law.
House Ownership Separate from the Land
Foreigners may have heard they can't own land under Thailand’s real estate laws and wonder how condo ownership avoids this restriction. Foreigners can own a home or structure on private land without owning the land itself. Foreigners can legally build a home on leased land, buy an existing home, obtain a land lease, or buy a condo registered and licensed by the Thailand Condominium Act. The first two methods are done at the local land office and require a 30-day public announcement of the property transfer. The land office completes the transfer at the end of 30 days.
The Tabian Baan (Tor.Ror. 13 for foreigners)
The Tabian Baan, or house registration book, is a booklet issued by the government. The booklet is blue for Thais and yellow for foreigners. It contains the official address of the residence. It's not an official ownership document, but it can be used as proof of residency to set up bank accounts and register for services such as telephone and internet services.
